Sejm relaxes reporting rules for business


The Sejm on 25 February voted to approve a Law on the Easing of Administrative Barriers for Citizens and Businesses, designed to cut red tape and slash the real cost of doing business by easing the various reporting requirements for companies.

The bill, which is to take effect in mid-2011, introduces changes to over 90 regulations. In 76 cases, it replaces statutory declarations or certificates with statements, a less onerous requirement; it also simplifies the provisions of 26 regulations (abolishing, for example, the need to produce declarations about obtaining tax and statistical information numbers NIP and REGON), and removes some penal sanctions from three laws. And it reduces maximum fines that can be imposed on a company in relation to a crime committed by a person acting on its behalf to 3% from 10% of annual revenues.

The drafting of the law was preceded by a review of 209 regulations, which revealed that no fewer than 129 laws laid down various regulatory requirements such as concessions, licenses, approvals, certificates, permits etc., often formulated in a less-than-clear manner and giving undue discretionary powers to officials.
