President sets seal on stricter VAT rules for delivery cars


President Bronislaw Komorowski has signed into law an amendment to the VAT act abolishing favourable tax treatment of passenger cars converted into delivery vehicles, effective from 1 January 2011. The new rules will be in force until the end of 2012.

Under the amendment, a full VAT exemption (for the car itself and for the fuel to power it) will apply only to cars with loading capacity of over 500 kg which are not passenger cars, as well as to certain categories of vehicles used for commercial purposes, such as vans, minibuses and special-purpose vehicles. The status of converted passenger cars will be identical to that of passenger cars. This means that buyers of such cars will be able to deduct 60% of the VAT amount on the invoice, but not more than PLN 6,000 (approx. €1,500).

The law also suspends for two years the VAT exemption on fuel for cars with total weight of up to 3.5 tonnes.
