Overhaul of business regulations a step closer


The Permanent Committee of the Council of Ministers on 15 November approved draft legislation designed to reduce administrative barriers to business in Poland.

The stated objective of the draft law, which is to take effect in mid-2011, is to cut red tape and slash real costs of doing business by reducing the number of required permits, licences, registrations and authorisations and easing the various reporting requirements, as well as to improve access to the professions. The document also envisages a sharp reduction of maximum fines that can be imposed on companies to 3% from 10% of annual revenues.

Altogether the draft law contains proposed changes to 96 business regulations. In 76 cases, it replaces statutory declarations or certificates with statements, a less onerous requirement, and simplifies the provisions of a further 26 regulations; it also removes some penal sanctions from three laws.

An analysis of 209 business regulations by the Ministry of Economy has revealed that no fewer than 129 laws provided for various regulatory requirements such as concessions, licenses, approvals, permits etc., often formulated in a less-than-clear manner and giving undue discretionary powers to officials.
